Thanks to the Maine Energy Marketers Association for having me present on marijuana in the workplace at their 2018 HR day in Freeport yesterday. We discussed Maine’s medical marijuana statute, 22 M.R.S. ss. 2421-2430, the current recreational marijuana statute, 7 M.R.S. chapter 417, and current legislative efforts to re-codify adult use marijuana in Maine, currently at L.D. 1719. Since I only represent employers and not employees, we discussed federal DOT drug testing and drug testing by Maine employers, as well as what rights Maine employers have to limit the use of marijuana in their workplace.
